LABOR
Employment and administration of foreign workers: Decree of the Government № 46/2011/ND-CP dated 17 June 2011 amending and supplementing some articles of the Decree № 34/2008/ND-CP dated 25 March 2008 on employment and administration of foreign employees working in Vietnam.
The Decree 46 amends and supplements the legal conditions applicable to the recruitment and administration of foreign workers in Vietnam. Areas of amendment/addition include specific regime applicable to Foreigners entering Vietnam to perform tender package or projects awarded to foreign contractors, (additional) categories of persons for which issuance of working permits is not required and circumstances and conditions under which a working permit can be reissued.
POST
Implementation of the Postal Code: Decree of the Government № 47/2011/ND-CP dated 17 June 2011. The Decree 47 specifies that issuance of business license for postal services shall be subject, in addition to the conditions stipulated in the Postal Code, to specific financial conditions: businesses providing postal services at provincial and inter-provincial level shall have a minimum registered investment capital of 2 billion VND, those business providing international postal services of 5 billion VND.
SECURITIES
Guidance on securities transactions: Circular № 74 of the Ministry of Finance dated 1 June 2011. Circular 74 provides guidelines for securities trading activities of companies listed and registered for trading and of public securities investment funds on the Stock Exchange. Relevant guidelines address notably methods for holding securities trading, cases for suspension, permissible price fluctuation range, trading for treasury shares, and prohibited trading.
PUBLISHING INDUSTRY
Representative offices in Vietnam of foreign publishers and foreign publishing organizations: Circular № 13 of the Ministry of Information and Communication dated 6 June 2011. Establishment of representative offices (RO) of foreign publishers in Vietnam shall be subject to the issuance of a special certificate by the Ministry of Information and Communication. Circular 13 encloses relevant application forms. Term of the said certificate shall be of five years.
