PROCEDURES AND STANDARD REQUIREMENTS FOR REGISTRATION OF ANIMAL FEED, FEED INGREDIENTS AND ADDITIVES,
Prakas № 51 of the Ministry of Agriculture, Forestry and Fisheries (“MAFF”), dated 16 January 2018.
Prakas 51 aims to determine the procedures and standard requirements for the registration of animal feed, feed ingredients, and additives in order to ensure the quality, effectiveness and safety of these products in accordance with the standard requirements prior to authorization for import/export, the trading, production, mixture and use of these products in Cambodia.
Under this Prakas, any individual or entity that imports, exports, trades, produces, or mixes animal feed, feed ingredients, and additives in Cambodia must submit a registration application for these products to the General Department of Animal Health and Production (“GDAHP”) of the MAFF.
The certificate of registration for animal feed, feed ingredients, and additives will be issued by the GDAHP upon obtaining the in principle authorization from the MAFF, and is valid for five years. The holder of the registration certificate must apply for re-registration of their products within three months prior to the certificate’s expiry date.
Based on this Prakas, the GDAHP may suspend or terminate the registration, the trading, production, mixture and invalidate the certificate if it is discovered that these products are a danger to life, health, livestock, and the environment. In such an event, any individual or entity subject to the above suspension or termination is obliged to collect the animal feed, feed ingredients, and additives for treatment or destruction in accordance with the Law on Animal Health and Production dated 28 January 2016 (“LAHP”).
The standard compound feed for pigs, chicken, ducks and cattle, along the standards of animal feed ingredients and prohibited additives are also listed under this Prakas. Any violation of the standard procedures and applicable standards concerning these as defined by this Prakas will be subject to penalties in accordance with the LHAP.
REAL ESTATE
ESTABLISHMENT OF KOH RONG SEA NATIONAL PARK,
Sub-decree №4 dated 8 February 2018.
The Koh Rong Sea National Park, with a total size of 52, 448 hectares, is located in Sihanouk Ville and Koh Kong Province, which also includes: Koh Rong, Koh Rong Soleum, Koh Touch, Koh Koun, Koh Tateam, Koh Mnors Krav and the nearby sea. The land area is 5,311 hectares whereas the sea area is 47,137 hectares.
The purpose of this sub-decree is to safeguard this ecological system, protect the natural beauty and scenery of this area, and promote the participation of the local community in protecting the natural area. The Ministry of Environment is obliged to prepare and manage this national park. The Sub-Decree 188 issued on 13 September 2016 and other regulations which are contrary to this new Sub-Decree will have no more effect.
DIRECTIVE OF MINISTRY OF AGRICULTURE FORESTRY AND FISHERIES (‘MAFF”) ON TAKING ACTION TO STRENGTHEN ANIMAL BUSINESS MANAGEMENT AND FISHERIES,
No. 115 dated 15 February 2018.
The MAFF recently noted that there are unfair competition practices prevalent in the livestock slaughter sector, and it is effectively operating as a cartel. Wholesalers and retailers have limited the costs and exclusivity on the import, export, distribution, or transport of goods and products.
These practices have also interfered with the degree and level of law enforcement. This has resulted in prices to keep rising, thereby contributing to increased levels of food inflation, indirectly affecting our daily life.
The MAFF has come up with a regulation as below:
The domestic slaughter Industry
- Break up the exclusivity of the livestock slaughter industry and eliminate anti-competitive practices;
- Offer additional investment opportunities in the livestock slaughter sector. However, this must be line with the technical principles stated under Sub-Decree No.108 issued on 24 August 2007 regarding “the management and sanitary control of slaughterhouses in regard to livestock for which relevant tax is paid”.
The following measures will be implemented:
– Increase the number of slaughterhouses in cities and districts ;
– Investors are permitted to expand their own business but are not allowed to sell out or transfer the rights to others. They are similarly prohibited from selling their licenses;
– Strengthen implementation by publicizing information on investment and slaughter auction sites in a transparent manner;
– Promote private investment in creating new slaughterhouses by not transferring them to state ownership unless it is specifically for regional or state investment purposes;
– Encourage associations, companies or farmers to open their own business in adherence to the law;
– Approve slaughterhouses that supply meat in communes and districts, for registration in the system by providing them with an interim preparatory period of three to five years in which to implement suitable food, hygiene, and sanitary standards.
– Strengthen animal hygiene, control of origin, and endemic areas by promoting the implementation of safety standards and disease control processes.
– Encourage wholesalers and retailers to label their products and properly display prices and other necessary information.
Business Production and Fishery products
- Eliminate exclusive rights on importing products by opening competitive opportunities to importing companies at the border and eliminate the sale of licenses;
- Cooperate with relevant institutions to strengthen implementation, and to eliminate exclusive investment by promoting the maintenance and repair of infrastructure;
- Incentivize the creation of diversified fishery production and to provide amortization of investment capital and the guaranteeing of investor contracts on both state and private land;
- Promote the gathering and publication of information on the types of natural fish species and domestic fish stocks by the General Department of Customs and Excise of Cambodia.
- Strengthen the quality and safety standards of production and commercial activities in this sector to ensure public welfare.
BANKING AND FINANCE
REVOCATION OF BUSINESS LICENSE FOR EXPORT-IMPORT OF METALS AND PRECIOUS STONES,
Announcement No. B9.018.123.Sor.Chor.Nor dated 13 February 2018.
Under this announcement, the National Bank of Cambodia publicly announced that it has revoked the licenses for the export-import of metals and precious stones of ten companies that have not carried out any import-export activities for the last four years. Those companies are listed below:
